Terms of Service

These Terms of Service ("Terms") govern your use of Papersmith ("the Service"), a web-based Markdown-to-PDF conversion tool operated by Papersmith ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Description of Service

Papersmith is a web application that converts Markdown documents into formatted PDF files. The Service offers a Free tier available to all users and a Pro tier available to paying subscribers. Features available on each tier are described on our pricing page.

2. Accounts

Some features of the Service require you to create an account. You are responsible for:

• Maintaining the security of your account credentials
• All activity that occurs under your account
• Providing accurate and current information when creating your account
• Notifying us immediately of any unauthorized access to your account

You must be at least 13 years of age to create an account. By creating an account, you represent that you meet this requirement.

3. Pro Subscriptions and Billing

Pro subscriptions are billed in advance on a monthly or annual basis. By subscribing, you authorize us (through our payment processor, Lemon Squeezy) to charge your payment method on a recurring basis until you cancel.

• Monthly plan: $5.00 USD per month
• Annual plan: $39.00 USD per year
• Cancellation: You may cancel at any time from your account page. Your Pro access continues until the end of the current billing period.
• Refunds: See our Refund Policy.
• Price changes: We will give at least 30 days' notice before changing subscription prices. Continued use after the effective date constitutes acceptance.

Payments are processed by Lemon Squeezy. By subscribing, you also agree to Lemon Squeezy's Terms of Service. Lemon Squeezy acts as the Merchant of Record for all transactions.

4. Acceptable Use

You agree not to use the Service to:

• Convert, distribute, or store content that is illegal, harmful, or infringes on the rights of others
• Attempt to gain unauthorized access to any part of the Service or its infrastructure
• Deliberately overload or disrupt the Service (e.g., automated bulk PDF generation without prior agreement)
• Circumvent or attempt to circumvent any feature gates, authentication, or access controls
• Scrape, reverse engineer, or reproduce the Service's core functionality

We reserve the right to suspend or terminate accounts that violate these restrictions.

5. Your Content

You retain all rights to the Markdown content you write or upload to Papersmith. We do not claim any ownership over your documents.

For Free users: your Markdown content is processed in memory during PDF conversion and is never stored on our servers. Nothing is written to a database.

For Pro users who use cloud saving: your documents are stored in Supabase (our database provider) and are accessible only to you. See our Privacy Policy for details.

You are solely responsible for the content you convert using the Service. We are not responsible for any content generated or distributed using Papersmith.

6. Intellectual Property

The Service, including its design, code, branding, and documentation, is owned by Papersmith and protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or other proprietary materials.

Papersmith incorporates open-source software. Relevant licenses are acknowledged in the project repository.

7. Service Availability

We aim to keep Papersmith available and reliable, but we do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any losses resulting from service downtime.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR THAT PDF OUTPUT WILL MEET ANY SPECIFIC REQUIREMENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PAPERSMITH AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after the effective date of changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes will be resolved through good-faith negotiation before any formal proceedings are initiated.
